OVERVIEW
Welcome to House Of Neoma. The terms “we”, “us” and “our” refer to House Of Neoma. We operate this online store and website, including its information, content, features, products, tools and services (together, the “Services”). Our store is powered by Shopify.
These Terms of Service (“Terms”), together with the policies referenced in them, explain the rights and responsibilities that apply when you access, browse or purchase through the Services.
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use the Services.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.
SECTION 1 — ELIGIBILITY AND ACCOUNTS
You must be at least the age of majority in your place of residence, or use the Services with the permission and supervision of a parent or legal guardian.
You may be asked to provide information such as your name, email address, billing information and delivery details. You agree that the information you provide will be current, accurate and complete.
You are responsible for keeping your account credentials secure and for activity undertaken through your account. You must not sell, transfer, assign or license your account to another person.
SECTION 2 — PRODUCTS AND PRESENTATION
We take reasonable care to describe and photograph our products accurately. Colours and appearance may vary slightly because of lighting, photography, screen settings and differences between devices.
Many House Of Neoma pieces use hand-block-printed cotton. Small variations in print placement, colour, texture or finish are natural characteristics of this process and are not necessarily faults. This does not limit your rights where a product is faulty, materially different from its description or otherwise fails to meet a consumer guarantee.
Our garments use relaxed and free-size designs. Fit varies according to the garment, body shape and height. Customers should review the available product information and size guidance or contact us before ordering if they require assistance.
We may update product descriptions, prices or availability where reasonably necessary. We may also limit quantities or discontinue a product, but this will not affect orders we have already accepted unless we contact you and provide an appropriate remedy.
SECTION 3 — MADE-TO-ORDER PRODUCTS
Our garments are made to order in Jaipur, India. Production ordinarily takes approximately 2–3 business days before dispatch. Delivery estimates displayed on our website include the expected production period unless stated otherwise.
Because production may begin shortly after an order is accepted, we cannot guarantee that a cancellation or change request can be accommodated. Contact us as soon as possible if you need to request a change. Nothing in this section limits rights or remedies available under the Australian Consumer Law.
SECTION 4 — ORDERS
Submitting an order is an offer to purchase. An order is accepted when we confirm acceptance or begin processing it. Payment must be authorised before an order can be accepted.
We may decline or cancel an order where reasonably necessary, including because of an evident pricing error, payment failure, suspected fraud, stock or production unavailability, delivery restrictions or an inability to fulfil the order. If we cancel an order after receiving payment, we will provide an appropriate refund to the original payment method.
Please check your order information carefully before submitting it. If we need to contact you about an order, we will use the email address, phone number or other details provided at checkout.
Orders are intended for personal or household use and not for unauthorised commercial resale.
SECTION 5 — PRICES, PAYMENT AND PROMOTIONS
Prices shown to Australian customers are displayed in Australian dollars and include GST where applicable. The price charged will be the price displayed when the order is placed, subject to correction of an obvious error.
Free standard delivery is available for eligible Australian orders. Any optional delivery charge, including an Express delivery charge, will be shown before checkout.
International customers may be responsible for customs duties, taxes or import charges imposed by their destination country. Where these charges cannot be calculated by us, they are not included in the product price or delivery charge.
Discounts and promotions may be subject to separate conditions, including validity periods, exclusions and usage limits. Unless stated otherwise, promotional offers cannot be combined. We may correct or withdraw a promotion affected by an error, misuse or fraud, subject to applicable law.
You agree to provide accurate and authorised payment information. Payments are processed securely through Shopify and available payment providers. We do not receive or store your complete payment-card details.
SECTION 6 — SHIPPING AND DELIVERY
Australian Standard delivery is estimated at 6–10 business days. Australian Express delivery is estimated at 3–5 business days and costs AUD $15. These are estimated total order-to-door timeframes and include the ordinary made-to-order production period.
Delivery times are estimates rather than guarantees. Delays may occur because of carriers, customs processing, weather, peak periods, public holidays or circumstances outside our reasonable control.
We will provide tracking information when it becomes available. Customers are responsible for providing a complete and accurate delivery address and for monitoring available tracking updates.
If we cannot supply your order within the stated timeframe or a reasonable time, contact us so that we can investigate and provide an appropriate solution. Nothing in this section limits your rights under the Australian Consumer Law.

SECTION 7 — RETURNS, STORE CREDIT AND CONSUMER GUARANTEES
Eligible change-of-mind returns may be requested within 30 days and are provided as store credit. Customers are responsible for change-of-mind return postage. Eligibility requirements, exclusions and instructions are provided in our Refund Policy.
Change-of-mind conditions do not apply where a product is faulty, damaged, unsafe, materially different from its description or otherwise fails to meet a consumer guarantee. Your rights in those circumstances are governed by the Australian Consumer Law and cannot be excluded by these Terms or our Refund Policy.
We may ask for photographs or other reasonable information so that we can assess an issue. Depending on the circumstances and applicable law, an available remedy may include a repair, replacement, refund or compensation.
SECTION 8 — INTELLECTUAL PROPERTY
The Services and their content, including our name, branding, text, graphics, photographs, videos, product presentation and website design, are owned by or licensed to House Of Neoma and are protected by applicable Australian and international intellectual property laws.
You may use the Services for personal, non-commercial purposes. You must not reproduce, republish, distribute, sell, modify or commercially exploit our content without prior written permission, except where permitted by law.
House Of Neoma’s names, logos, product names, designs and slogans may be trademarks or other protected property of House Of Neoma or its licensors. Shopify’s name, logo, products and services are the property of Shopify. Other names and marks belong to their respective owners.
SECTION 9 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES
The Services may provide access to tools, payment methods, applications or functionality operated by third parties. Those services may be subject to the third party’s own terms and privacy practices.
We do not control independent third-party services and are not responsible for their separate content or practices. However, nothing in this section excludes responsibility that cannot lawfully be excluded.
SECTION 10 — THIRD-PARTY LINKS
The Services may contain links to websites or platforms operated by third parties. A link does not necessarily mean that we endorse or control that website.
If you choose to visit or transact with a third party, review its terms, policies and practices. Questions about a third party’s independent products or services should generally be directed to that third party.
SECTION 11 — RELATIONSHIP WITH SHOPIFY
House Of Neoma is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with House Of Neoma. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and House Of Neoma, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with House Of Neoma.
SECTION 12 — PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy. Certain personal information is also processed by Shopify in accordance with the Shopify Consumer Privacy Policy.
Because Shopify hosts the Services, information submitted through our store may be transmitted to Shopify and relevant service providers, including providers located outside your country. Please review our Privacy Policy for further information.
SECTION 13 — FEEDBACK AND SUBMISSIONS
If you voluntarily send us feedback, suggestions, photographs, reviews or other material, you confirm that you have the right to provide it and that it does not infringe another person’s rights.
Unless we agree otherwise in writing, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that material for operating, improving or promoting House Of Neoma. We will not be required to publish or respond to any submission.
You must disclose any payment, gift or incentive connected with a review or endorsement. We may remove content that is unlawful, misleading, abusive, infringing or otherwise inappropriate.
SECTION 14 — ERRORS AND CORRECTIONS
Information on the Services may occasionally contain typographical errors, technical errors or omissions relating to descriptions, prices, promotions, availability or delivery estimates.
We may correct genuine errors and update information. If an error materially affects an order already placed, we will contact you and provide an appropriate option, which may include confirming the corrected order or cancelling it for a refund.
SECTION 15 — PROHIBITED USES
You must not use the Services:
- for an unlawful, fraudulent or malicious purpose;
- to infringe our rights or the rights of another person;
- to harass, abuse, threaten, defame or discriminate against another person;
- to submit false, misleading or deceptive information;
- to transmit malware, viruses or harmful code;
- to collect another person’s information unlawfully;
- to send spam or unauthorised commercial communications;
- to impersonate another person or organisation;
- to scrape, copy, interfere with or circumvent the security or operation of the Services; or
- to use the Services in a way that could damage House Of Neoma, Shopify, our customers or another person.
We may restrict or terminate access where we reasonably believe these Terms have been materially breached or the Services are being used unlawfully.
SECTION 16 — AVAILABILITY AND WARRANTIES
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or another applicable law that cannot lawfully be excluded, restricted or modified.
Subject to those non-excludable rights, we do not guarantee that the website will always be uninterrupted, secure or free from technical errors. We may temporarily suspend access for maintenance, security or operational reasons.
SECTION 17 — LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising under the Australian Consumer Law that cannot lawfully be excluded or limited.
To the maximum extent permitted by law, House Of Neoma will not be liable for indirect or consequential loss that was not reasonably foreseeable, or for loss caused solely by circumstances outside our reasonable control.
Where the law permits us to limit a remedy for a failure to comply with a non-excludable guarantee, our liability will be limited to the remedy permitted by that law.
SECTION 18 — CUSTOMER RESPONSIBILITY
You are responsible for loss reasonably suffered by House Of Neoma as a direct result of your unlawful use of the Services, fraud or material breach of these Terms. This does not apply to the extent that the loss was caused or contributed to by House Of Neoma, Shopify or another party.
SECTION 19 — TERMINATION
You may stop using the Services at any time. We may suspend or terminate your access where reasonably necessary because of unlawful conduct, fraud, security risks or a material breach of these Terms.
Termination does not affect rights and obligations that arose before termination. Provisions that by their nature should continue—including intellectual property, liability, privacy and governing law—will survive termination.
SECTION 20 — SEVERABILITY AND WAIVER
If part of these Terms is found to be unlawful, void or unenforceable, that part will be severed or limited to the minimum extent necessary. The remaining provisions will continue to operate.
If we do not immediately enforce a right under these Terms, that does not waive the right.
SECTION 21 — ENTIRE AGREEMENT AND ASSIGNMENT
These Terms and the policies referenced in them form the agreement between you and House Of Neoma concerning your use of the Services and replace earlier versions relating to the same subject matter.
You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights or obligations as part of a genuine business transfer, restructure or sale, subject to applicable law.
SECTION 22 — GOVERNING LAW
These Terms and any agreement through which we provide the Services are governed by the laws of Victoria, Australia and applicable laws of the Commonwealth of Australia.
The parties submit to the jurisdiction of the courts of Victoria and courts entitled to hear appeals from them. Nothing in this section limits any rights a consumer has to bring proceedings in another jurisdiction where permitted by law.
SECTION 23 — CHANGES TO THESE TERMS
The current version of these Terms is available on this page. We may update these Terms to reflect changes to our Services, practices or legal obligations.
Material changes will be notified where required by law and will apply from the date stated in the notice. Changes will not retrospectively remove rights that have already arisen under an accepted order.
